What is the 1033 Program? Section 1033 of the National Defense Authorization Act of 1997 authorizes the Department of Defense to transfer excess military property to state and local law enforcement agencies. The eligible agencies in law enforcement activities are government agencies whose primary function is the enforcement of applicable Federal, State, and local laws, and whose compensated full-time law enforcement officers have powers of arrest and apprehension. All DoD excess property can be used for counter-drug and other law enforcement activities with the exception of the operation of jails. This applies to all property acquired in the future or any property previously acquired through the DoD 1033 Program.
Who is operating Wisconsin's 1033 Program? The Wisconsin Technical College System Foundation (Foundation) through an agreement with Office of Justice Assistance (OJA) has been charged with administration of the program. How do I enroll in the 1033 Program? There are five forms that need to be completed and signed to be enrolled in the 1033 Program. - Memorandum of Agreement (MOA): The MOA is an agreement between the Office of Justice Assistance and the Defense Logistics Agency (DLA).
- Enrollment Form: The enrollment form is a commitment from the LEA to pay the $500 annual enrollment fee for the current year.
- Data Sheet: The information from the Data Sheet will determine the quantity of items your department will be allowed to obtain. The Data Sheet should be kept current and can be updated when needed. Each year, the Law Enforcement Agency (LEA) will be asked to complete a new MOA/Data Sheet.
- State Plan: Your signature on the last page of the State's 1033 Program Plans, Policies and Procedures document simply means that your office will comply with the rules of the 1033 Program.
- Disposal Policy: Each LEA needs to have a disposal policy on file.
